Privacy Notice

For QUIMICA LUCAVA, S.A. de C.V., the legitimate, controlled and informed treatment of your personal data is of vital importance to achieve the corporate objectives across all areas of the business and to reiterate our commitment to your privacy and the right to informational self-determination.

The purpose of this Privacy Notice is to inform you about the treatment that will be given to your personal data when they are collected, used, stored and/or transferred by the company.

In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter “the Law”), by the legislation in force and applicable in the United Mexican States, we hereby inform you of the following:

 

1- Identity of the Person Responsible for the Processing of your Personal Data

QUIMICA LUCAVA, SA DE CV (hereinafter referred to as LUCAVA), domiciled at Carretera Panamericana, km. 284, 2da Fracción de Crespo, C.P. 38110, Celaya, Guanajuato, Mexico, is responsible for collecting your personal data, the use given to them and their protection, and therefore, who will decide on the treatment of these.

LUCAVA may collect and, where appropriate, process the following personal data, depending on the relationship that exists with you:

  • Marital Status
  • Information related to whether you have children and number of children
  • Address
  • Nationality
  • E-mail address
  • Home, work, mobile phone
  • Preferred method of contact Information on how you heard about our products and services
  • Social security number

 

Other personal data, both sensitive and non-sensitive, which are not included in the above lists may be processed provided that such data are considered to be of the same nature and are not excessive in relation to the purposes for which they are collected.

 

3- Purposes of Data Processing

LUCAVA collects, uses, stores or transfers your personal data, to the extent permitted by applicable laws, to carry out the following:

  • Fiscal information of the natural or legal person for the sale of our products and services.
  • Development of new products and services
  • Knowing the market and the performance of the company.
  • Follow-up of sales in order to achieve customer satisfaction.
  • Studies to determine customer satisfaction Creation of consumer files for follow-up.
  • Creation of directories for contact. Interrelation of databases to know the consumer’s profile and needs.
  • Sending promotions about our products or services according to what we consider to be the consumer’s interests.

LUCAVA may use your personal data for other purposes, provided that such purposes are compatible and can be considered analogous to the above.

Your personal data will be processed only for the time necessary to fulfill the purposes described above and/or in accordance with the provisions of the applicable legal provisions.

 

4- Means of Obtaining Personal Data

For the purposes indicated in this privacy notice, we may collect your personal data in different ways: electronically (web, e-mail, chat, online surveys, etc.), by telephone and verbally in person with the owner.

 

5- Security of Personal Data

LUCAVA implements technical, administrative and physical security measures necessary to protect your personal data and prevent its damage, loss, alteration, destruction or unauthorized use, access or processing.

Only authorized personnel, who have complied with and observed the relevant confidentiality requirements, may participate in the processing of your personal data. Authorized personnel are prohibited from allowing access by unauthorized persons and from using your personal data for purposes other than those set out in this Privacy Notice. The obligation of confidentiality of the persons involved in the processing of your personal data subsists even after the termination of the relationship with LUCAVA.

 

6- Transfers of Personal Data

LUCAVA ensures through the signing of agreements and/or the adoption of other binding documents, that such third parties maintain adequate security, administrative, technical and physical measures to safeguard your personal data, as well as that such third parties only use your personal data for the purposes for which they were hired and in accordance with this Privacy Notice.

LUCAVA will not assign, sell or transfer your personal data to third parties unrelated to LUCAVA without your prior consent. However, LUCAVA may transfer your personal data in the cases provided for in the Federal Law on the Protection of Personal Data Held by Private Parties.

 

7- Means to exercise ARCO Rights

You as the owner of personal data may exercise before the LUCAVA Data Protection Committee the rights of access, rectification, cancellation and opposition regarding the processing of your personal data. Likewise, you may revoke, at any time, the consent that you have granted and that is necessary for the processing of your personal data by giving notice via written request addressed to the following address: Carretera Panamericana, Km. 284, 2da Fracción de Crespo, 38110, Celaya, Guanajuato, México C. P. 38110, from 10:00 to 17:00 hours, on working days, with attention to Isabel Hipólito, or by means of a request made to our Customer Service System (461) 192 0600 ext 129, or by e-mail to atencion-clientes@quimicalucava.com.mx.

By virtue of the right of rectification, you may request the correction or completion of any incorrect or incomplete personal data held by LUCAVA. You are obliged to inform LUCAVA when a change or correction is to be made to your personal data and this fact only comes to your knowledge.

LUCAVA, will respond to requests from the holder of the information, provided that any of the exceptions contained in the Act does not apply, and the applicant complies with the requirements contained in Article 29 of the Act as described below:

    1. To indicate the name of the owner and address or other means of communicating the response to the request;
    2. The documents proving the identity or, as the case may be, the legal representation of the owner;
    3. The clear and precise description of the personal data in respect of which the exercise of any of the aforementioned rights is sought, and
    4. Any other element or document that facilitates the location of the personal data, i.e. to which area of LUCAVA they were provided, the person to whom they were provided or the area of the company to which the person to whom the data were provided belongs.

 

The Data Subject may stop receiving promotional messages by telephone, post and/or email by sending a request to the customer service hotline or by sending an email to atención-clientes@quimicalucava.com.mx

8- Consent

With this Privacy Notice, the Holder tacitly consents to the use of his/her personal information and is duly informed of the data collected from him/her and for what purposes, accepting the terms contained herein, which were prepared in compliance with the Federal Law for the Protection of Personal Data in Possession of Individuals.

 

9- Changes to the Privacy Notice

LUCAVA reserves the right to amend or modify this Privacy Notice as it deems appropriate, to comply with changes to data protection legislation or to comply with internal LUCAVA provisions..

Any amendments to this Privacy Notice may be viewed on our website at www.grupolucava.com in the “About Us/Privacy Notice” section, where LUCAVA will make the updated Privacy Notice available to you when significant changes are made to this Privacy Notice, as well as when your consent is required.

This Privacy Notice, as well as LUCAVA’s handling of the Law in general, is governed by the legislation in force and applicable in the United Mexican States. Any dispute arising from its application shall be heard before the competent Jurisdictional Bodies in Mexico City, Mexico.
